Kullanım Şartları — Mobies

Bu Kullanım Şartları ("Şartlar"), Mehmet Ali Dengiş ("Geliştirici", "biz") tarafından sunulan Mobies mobil uygulamasının ("Uygulama") kullanımını düzenler. Uygulamayı indirerek, kurarak veya kullanarak bu Şartları kabul etmiş olursunuz. Kabul etmiyorsanız Uygulamayı kullanmayın.

1. Hizmet

Mobies; esnaf, küçük işletme sahipleri ve serbest çalışanlar için bir işletme defteri uygulamasıdır. Müşteri kayıtları, randevular, veresiye/cari hesap, gelir-gider, stok, iş listesi, fatura ve teklif gibi araçlar sunar.

Uygulama işletme kullanımı içindir; hukuki, vergisel veya muhasebe danışmanlığı değildir. Girdiğiniz kayıtların doğruluğundan ve yürürlükteki mevzuata uyumdan siz sorumlusunuz. Uygulamanın ürettiği fatura, teklif ve raporlar bilgi amaçlıdır; resmî belge yerine geçmez ve e-Fatura/e-Arşiv gibi yasal sistemlere bağlı değildir.

2. Lisans

Size, bu Şartlara ve Apple App Store kullanım kurallarına tabi olmak üzere; sahibi olduğunuz veya kontrol ettiğiniz cihazlarda Uygulamayı kullanmanız için sınırlı, münhasır olmayan, devredilemez ve geri alınabilir bir lisans veriyoruz.

Şunları yapamazsınız:

• Kanunun izin verdiği haller dışında Uygulamayı tersine mühendislikle çözmek, kaynak koduna dönüştürmek veya kaynak kodunu elde etmeye çalışmak;
• Uygulamayı kopyalamak, değiştirmek veya türev çalışma üretmek;
• Uygulamayı kiralamak, satmak veya alt lisanslamak;
• Uygulamayı hukuka aykırı amaçlarla ya da üçüncü kişilerin haklarını ihlal edecek şekilde kullanmak.

3. Verileriniz

Uygulamaya girdiğiniz işletme verileri (müşteriler, randevular, veresiye kayıtları, gelir-gider, stok vb.) yalnızca cihazınızda saklanır. Bu verileri saklayan bir sunucu işletmiyoruz; hiçbir kaydınız bize iletilmez.

Bunun doğal sonucu şudur: yedeklemeden siz sorumlusunuz. Cihazınızı kaybederseniz, sıfırlarsanız veya Uygulamayı silerseniz verileriniz de silinir ve bizim tarafımızdan geri getirilemez. Uygulamanın dışa aktarma özelliğini düzenli olarak kullanmanızı öneririz.

Dışa aktardığınız veya paylaştığınız dosyalar (PDF, CSV, JSON) cihazınızdan çıkar ve gönderdiğiniz kişi/uygulamanın kontrolüne geçer. Bu paylaşımın sorumluluğu size aittir.

4. Abonelikler ve Uygulama İçi Satın Alma

Mobies, Mobies Premium adı altında otomatik yenilenen aylık ve yıllık abonelikler sunar. Ürün adları, fiyatlar ve süreler satın almayı onaylamadan önce Uygulamada ve App Store satın alma ekranında gösterilir.

• Ücretsiz deneme: Yeni aboneler için 14 günlük ücretsiz deneme sunulur. Deneme süresi içinde iptal ederseniz herhangi bir ücret alınmaz.
• Ödeme: Ücret, satın almayı onayladığınızda Apple Kimliğinize tanımlı ödeme yöntemine yansıtılır.
• Otomatik yenileme: Abonelik, mevcut dönemin bitiminden en az 24 saat önce iptal edilmedikçe otomatik olarak yenilenir.
• Yenileme ücreti: Yenileme bedeli, mevcut dönemin bitiminden önceki 24 saat içinde o günkü geçerli fiyat üzerinden tahsil edilir.
• Yönetme ve iptal: Aboneliğinizi cihaz ayarlarından yönetebilir veya iptal edebilirsiniz: Ayarlar → Apple Kimliğiniz → Abonelikler.
• İade: İade talepleri Apple tarafından kendi politikaları çerçevesinde değerlendirilir. Ödemeleri doğrudan biz tahsil etmiyoruz.
• Fiyat değişikliği: Fiyatlar değişebilir. Apple, yürürlükteki kurallar gereği yenilemeden önce sizi bilgilendirir ve gerektiğinde onayınızı ister.

Bu Şartlara ek olarak, gerekli olduğu ölçüde Apple'ın standart lisans sözleşmesi (Standard EULA) uygulanır:

5. Kabul Edilebilir Kullanım

Uygulamayı yalnızca hukuka uygun işletme amaçlarıyla kullanmayı kabul edersiniz. Uygulamayı; kişisel verilerin korunması, iş hukuku veya tüketicinin korunması mevzuatını ihlal edecek şekilde veri saklamak ya da işlemek için kullanamazsınız.

Uygulamaya müşterilerinize ait kişisel veri (ad, telefon, borç bilgisi vb.) giriyorsanız, bu verilerin veri sorumlusu sizsiniz. İlgili kişileri bilgilendirmek ve gerekli hukuki dayanağı sağlamak sizin yükümlülüğünüzdedir.

6. Sorumluluk Reddi

UYGULAMA "OLDUĞU GİBİ" VE "MEVCUT HÂLİYLE", AÇIK VEYA ZIMNİ HİÇBİR GARANTİ VERİLMEKSİZİN SUNULMAKTADIR; SATILABİLİRLİK, BELİRLİ BİR AMACA UYGUNLUK VE İHLAL ETMEME GARANTİLERİ DÂHİL. Uygulamanın hatasız veya kesintisiz çalışacağını ya da verilerin hiçbir koşulda kaybolmayacağını garanti etmiyoruz. Cihaz kaybı, işletim sistemi güncellemeleri veya Uygulamanın kaldırılması, yedeğiniz yoksa veri kaybına yol açabilir.

7. Sorumluluğun Sınırlandırılması

YÜRÜRLÜKTEKİ MEVZUATIN İZİN VERDİĞİ AZAMİ ÖLÇÜDE, GELİŞTİRİCİ; DOLAYLI, ARIZİ, ÖZEL, SONUÇSAL VEYA CEZAİ ZARARLARDAN VE KÂR, VERİ, İŞ YA DA İTİBAR KAYBINDAN SORUMLU DEĞİLDİR. UYGULAMAYLA İLGİLİ HERHANGİ BİR TALEPTE TOPLAM SORUMLULUĞUMUZ, TALEBİN DOĞUMUNDAN ÖNCEKİ ON İKİ (12) AY İÇİNDE ABONELİK İÇİN ÖDEDİĞİNİZ TUTARI AŞAMAZ.

Bu madde, tüketici mevzuatının emredici hükümlerini ve ağır kusur ya da kasttan doğan sorumluluğu ortadan kaldırmaz.

8. Uygulamada ve Şartlarda Değişiklik

Uygulamayı ve bu Şartları zaman zaman güncelleyebiliriz. Esaslı değişiklikler bu sayfadaki "Son güncelleme" tarihinin yenilenmesiyle yansıtılır. Değişiklikten sonra Uygulamayı kullanmaya devam etmeniz güncellenmiş Şartları kabul ettiğiniz anlamına gelir.

9. Fesih

Uygulamayı istediğiniz zaman kaldırarak kullanmayı bırakabilirsiniz. Mevzuat veya mağaza politikaları gerektirdiğinde özellikleri askıya alabilir ya da sonlandırabiliriz. Niteliği gereği devam etmesi gereken hükümler (sorumluluk reddi, sorumluluğun sınırlandırılması, uygulanacak hukuk) fesihten sonra da geçerliliğini korur.

10. Uygulanacak Hukuk

Bu Şartlar, kanunlar ihtilafı kurallarına bakılmaksızın Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda Türkiye mahkemeleri ve icra daireleri yetkilidir; ancak bulunduğunuz ülkedeki emredici tüketici koruma hükümleri saklıdır.

Terms of Service — Mobies

These Terms of Service ("Terms") govern your use of the Mobies mobile application ("App") provided by Mehmet Ali Dengis ("Developer", "we", "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The Service

Mobies is a business ledger app for tradespeople, small business owners and freelancers. It provides tools such as customer records, appointments, credit accounts and receivables, income and expenses, stock, work lists, invoices and quotes.

The App is intended for business use and is not legal, tax, or accounting advice. You are responsible for the accuracy of the records you enter and for compliance with applicable law. Invoices, quotes and reports produced by the App are informational; they are not official documents and are not connected to any government e-invoicing system.

2. Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, subject to these Terms and to the usage rules of the Apple App Store.

You may not:

• Reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by law;
• Copy, modify, or create derivative works of the App;
• Rent, lease, sell, or sublicense the App;
• Use the App for unlawful purposes or in violation of third-party rights.

3. Your Data

The business data you enter (customers, appointments, credit records, income and expenses, stock and so on) is stored only on your device. We do not operate servers that store this content, and none of your records are transmitted to us.

A direct consequence of this: backups are your responsibility. If you lose your device, reset it, or delete the App, your data goes with it and we cannot recover it. We recommend using the App's export feature regularly.

Files you export or share (PDF, CSV, JSON) leave your device and pass into the control of whoever or whatever you send them to. That sharing is your responsibility.

4. Subscriptions and In-App Purchases

Mobies offers auto-renewable monthly and yearly subscriptions under the name Mobies Premium. Product names, prices and durations are shown in the App and on the App Store purchase sheet before you confirm payment.

• Free trial: New subscribers get a 14-day free trial. Cancel during the trial and you pay nothing.
• Payment: Payment is charged to the payment method on your Apple ID when you confirm the purchase.
• Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• Renewal charge: Your account is charged for renewal within 24 hours prior to the end of the current period, at the then-current price.
• Manage or cancel: You can manage or cancel your subscription in your device settings: Settings → your Apple ID → Subscriptions.
• Refunds: Refund requests are handled by Apple under its own policies. We do not process payments directly.
• Price changes: Prices may change. Where required, Apple notifies you before renewal and asks for your consent.

5. Acceptable Use

You agree to use the App only for lawful business purposes. You must not use the App to store or process data in violation of applicable privacy, employment, or consumer protection laws.

If you enter personal data belonging to your customers (name, phone number, outstanding balance and so on), you are the data controller for that data. Informing those individuals and establishing a lawful basis for processing is your obligation.

6. Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the App will be error-free or uninterrupted, or that data will never be lost. Device loss, OS updates, or uninstalling the App may result in data loss if you have not backed up your data.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SUBSCRIPTIONS IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.

Nothing in this section excludes liability that cannot be excluded under mandatory consumer law, or liability for gross negligence or wilful misconduct.

8. Changes to the App and These Terms

We may update the App or these Terms from time to time. Material changes will be reflected by updating the "Last updated" date on this page. Continued use of the App after changes constitutes acceptance of the revised Terms.

9. Termination

You may stop using the App at any time by uninstalling it. We may suspend or discontinue features if required by law or store policies. Sections that by their nature should survive (disclaimer, limitation of liability, governing law) will survive termination.

10. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. Courts in Türkiye shall have jurisdiction, except where mandatory consumer protection laws in your country of residence require otherwise.
